Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and Permit Maid LLC, a New Jersey limited liability company with its principal place of business in Newark, New Jersey (“Permit Maid,” “we,” “us,” or “our”). By creating an account, accessing, or using the Permit Maid platform at permitmaid.com (the “Platform”), you agree to be bound by these Terms. If you do not agree, do not use the Platform. If you are using the Platform on behalf of a business entity, you represent that you have authority to bind that entity, and “you” refers to that entity.

1. Description of Service

Permit Maid provides a software platform that enables licensed contractors, design professionals, property owners, and other applicants to prepare, validate, and submit permit applications electronically to participating government agencies. The Platform currently supports construction permit applications submitted to municipal enforcing agencies in accordance with the New Jersey Uniform Construction Code (N.J.A.C. 5:23), and may be expanded to support additional permit types and jurisdictions from time to time. The Platform includes document validation, fee calculation, application tracking, and electronic transmission of applications to participating agencies.

Permit Maid is a technology provider. We are not a government agency, and we do not review, approve, or issue permits. All permit review, approval, rejection, and issuance decisions are made exclusively by the applicable municipal enforcing agency. Use of the Platform does not guarantee permit approval.

2. Account Registration and Eligibility

  • You must provide accurate, current, and complete information during registration, including your legal name, business name, contact information, and, where applicable, professional license numbers and insurance information.
  • You are responsible for maintaining the accuracy of your account information, including license and insurance expiration dates. The Platform's validation features rely on the information you provide.
  • You are responsible for safeguarding your account credentials and must notify us immediately of any unauthorized use of your account.
  • You must be at least 18 years of age and legally capable of entering binding contracts.
  • For construction permit applications: if you file under New Jersey's homeowner exemption (N.J.A.C. 5:23-2.15), you represent that you own and occupy the single-family dwelling for which the permit is sought and that you are legally permitted to perform the work without a professional license.

3. Authorization to Transmit Applications

By submitting a permit application through the Platform, you authorize Permit Maid to transmit your application, including all forms, documents, signatures, and payment information you provide, to the municipal enforcing agency you designate. You acknowledge that:

  • You, not Permit Maid, are the applicant of record on all permit applications.
  • All information in your application is provided by you, and you are solely responsible for its accuracy, truthfulness, and completeness.
  • Electronic signatures you provide carry the same legal effect as handwritten signatures, consistent with the New Jersey Uniform Electronic Transactions Act (N.J.S.A. 12A:12-1 et seq.).
  • Knowingly providing false information on a permit application may constitute a violation of law, and you bear sole responsibility for any such violation.

4. Pre-Submission Validation; No Guarantee

The Platform performs automated validation checks on applications prior to submission, including document completeness, license and insurance currency based on the information you provide, internal consistency, and fee calculation. These checks are an aid, not a guarantee. Permit Maid does not warrant that a validated application will be accepted, deemed complete, or approved by any municipality. Municipal officials retain sole discretion over all permitting decisions, including requests for additional documents not captured by the Platform's validation rules.

5. Fees and Payment

  • Platform fees: You agree to pay Permit Maid's service fees as displayed at checkout at the time of your transaction. Current pricing for single filings and subscription plans is published on our pricing page and may be updated from time to time; the price displayed at checkout when you submit is the price that applies. All Platform fees are charged at the time of submission and are non-refundable once an application has been transmitted to the municipality, except as required by law.
  • Government fees: Permit fees, plan-review fees, and government-imposed surcharges applicable to your permit type are established by the issuing agency and applicable law, collected through the Platform where supported, and remitted to the appropriate authority. For New Jersey construction permits, this includes the State electronic permit surcharge (N.J.A.C. 5:23-4.22, where applicable) and the DCA training surcharge. Government fees are subject to the issuing agency's refund policies, not ours.
  • Subscription plans renew automatically each billing cycle until cancelled. You may cancel at any time, effective at the end of the current billing cycle. Filing allowances do not roll over between cycles.
  • If you exceed your plan's filing allowance, you will be prompted to either upgrade your plan or pay the then-current single-filing rate for additional filings.
  • Payments are processed by Stripe, Inc. Your payment information is subject to Stripe's terms and privacy policy.

6. Acceptable Use

You agree not to: (a) submit applications containing false, fraudulent, or misleading information; (b) impersonate any person or entity, or misrepresent your professional licensure; (c) use the Platform to file on behalf of third parties without legal authority to do so; (d) attempt to gain unauthorized access to the Platform, other users' accounts, or municipal dashboard systems; (e) interfere with or disrupt the Platform's operation; (f) reverse engineer, scrape, or copy the Platform or its data; (g) use the Platform for any unlawful purpose.

7. Your Content and Documents

You retain ownership of the documents and information you upload. You grant Permit Maid a limited, non-exclusive license to store, process, display, and transmit your content solely to provide the service, including transmission to the designated municipality and retention as required by law. You represent that you have the right to upload all content you submit and that it does not infringe any third party's rights.

For construction permit records, permit records transmitted to a municipality become part of that municipality's official records and are subject to government records-retention requirements (N.J.A.C. 5:23-2.16A) and the New Jersey Open Public Records Act (N.J.S.A. 47:1A-1 et seq.). Deletion of your Permit Maid account does not delete records held by a municipality.

8. Intellectual Property

The Platform, including its software, design, validation logic, databases, and content (excluding your content), is owned by Permit Maid and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Platform other than the limited right to use it in accordance with these Terms.

9. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PERMIT MAID DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY APPLICATION WILL BE APPROVED BY ANY MUNICIPALITY. PERMIT MAID IS NOT RESPONSIBLE FOR THE ACTS, OMISSIONS, DELAYS, OR DECISIONS OF ANY MUNICIPALITY OR GOVERNMENT AGENCY.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERMIT MAID'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO PERMIT MAID IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100). IN NO EVENT SHALL PERMIT MAID BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, PROJECT DELAYS, OR COSTS OF SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold harmless Permit Maid and its members, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your violation of these Terms; (b) inaccurate or fraudulent information in your applications; (c) your violation of any law or third-party right; or (d) work you perform under any permit.

12. Termination

You may close your account at any time. We may suspend or terminate your account for violation of these Terms, fraudulent activity, or non-payment, with notice where practicable. Upon termination, your right to use the Platform ceases, but the provisions that by their nature should survive will survive. You may request an export of your application records prior to account closure.

13. Dispute Resolution

These Terms are governed by the laws of the State of New Jersey without regard to conflict-of-laws principles. Any dispute shall be resolved in the state or federal courts located in Essex County, New Jersey, and you consent to personal jurisdiction there. THE PARTIES WAIVE TRIAL BY JURY. You waive any right to participate in a class action against Permit Maid.

14. Changes to Terms

We may modify these Terms by posting an updated version with a new effective date and providing notice through the Platform or by email at least fifteen (15) days before material changes take effect. Continued use after the effective date constitutes acceptance of the changes.

15. Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Permit Maid regarding the Platform. If any provision is held unenforceable, the remainder remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to us: contact@permitmaid.com.
